Terms of Service

Effective date: September 11, 2026

These Terms of Service (“Terms”) govern the use of We Wil Marry (“Service”), a web application operated by REDHEAD STUDIOS LTDA, a legal entity registered in Brazil under CNPJ 48.257.504/0001-18 (“Redhead Studios”, “we”, “our”).

This page describes how the product works. It is not legal advice.

By creating an account, acknowledging these Terms at sign-up when Clerk shows that checkbox, or continuing through onboarding and creating a site, you agree to these Terms and to the Privacy Policy. We store the version of each document (its effective date) and the time of acceptance on your user record. If you do not agree, do not use the Service.

Guests are not asked to accept these Terms in the product. How we process guest data is in the Privacy Policy (contract and legitimate interests).

1. About We Wil Marry

We Wil Marry is a wedding-website product. Couples (and invited editors) publish a page at a path on welmarry.com so guests can see the story, date, place, photos and videos, RSVP, gift list, and other wedding details.

Couples pay for site time, not for features. While a site is active, the published capabilities of the product are available without a feature paywall.

We Wil Marry does not process gift money between guests and the couple. Gift transfers are direct bank transfers (for example PIX). Receipts uploaded in the product are unverified evidence only. Section 9 describes that in full.

2. Eligibility

You must have legal capacity to contract under Brazilian law to create an account and buy site time.

The wedding page may list household members who are minors. That is described in the Privacy Policy. Creating an owner or editor account is for adults acting for the couple.

3. Accounts and editor access

You create an account with Clerk (e-mail and password or Google). You are responsible for keeping that access confidential and for activity under your account.

One account may own several wedding sites. Each site has its own public link, editors, guest data, media, and time balance.

The owner may invite editors by name and e-mail. There is one permission level. Editors may do everything on that site except remove or replace the owner or delete the account — including Site Access, buying and refunding site time, and seeing confirmed-guest and gift data. A site may have at most 10 editors at a time.

You are responsible for who you invite and for the content you and your editors publish.

If you already have an account and finish onboarding with the same e-mail, the new draft is attached as another owned site rather than a second account.

4. Paying for site time

We sell time that keeps a site online, not a menu of locked features.

  • The account’s first owned site receives three calendar months of free time when durable site creation succeeds.
  • Every later owned site receives seven days.
  • You may buy more time while the site is live or in the grace period. Purchased months stack from the later of now or the current expiry.
  • Vitalício means no further time purchase is needed while We Wil Marry operates. It does not survive account deletion or a product shutdown, and it does not promise hosting after either event.
  • Time is bought through Stripe Checkout (embedded when possible; a Stripe-hosted page if the payment method requires it). We do not store full card numbers.
  • Prices and currencies are those Stripe shows at checkout. Launch sales are in Brazilian reais; the catalogue may change.
  • While a site is still active, purchases may be offered at a loyalty discount. That discount is lost once the site lapses.

No extra time is granted until Stripe confirms payment. A declined or abandoned checkout does not extend the site. Delayed confirmation is shown as payment verification, not as success.

5. Refunds and chargebacks

A purchase, including Vitalício, may be refunded within 7 days of payment. Refunding reverts the time that purchase added and restores the prior entitlement.

Ask for a refund in the product (purchase detail → request refund) during that window. We do not use Stripe Customer Portal as the refund path.

After 7 days, purchases are final, except where the law requires us to honour a chargeback or similar dispute. A full chargeback or full refund after that window still reverts the time that purchase added.

6. Expiry, grace, and reactivation

When paid (or trial) time ends, the site is deactivated, not immediately deleted.

  • Visitors see a branded “temporarily unavailable” page. It does not show wedding content and does not disclose your billing state. It is distinct from an unpublished site and from an unknown link.
  • Owners and editors still reach the retained site, with a banner that shows the deletion countdown, that data is kept for the grace period, that the loyalty discount is lost, and a Reactivate action.
  • Grace lasts one year from expiry. During grace you may buy time again (without the active-site loyalty discount). Buying time restores the public site.
  • After grace, we permanently clean up the site: wedding content, guest identities, RSVP and gift records, receipts, media, analytics, and related billing records for that site.

An unpublished site is a separate choice by the owner: the public link does not resolve, but time still runs.

7. Account deletion

Deleting your Clerk account immediately schedules irreversible deletion of every site you own: remaining paid time (including Vitalício), guest data, billing records, and media. Editor access you held on other people’s sites is revoked. This cannot be undone from the product.

Site deletion (without deleting the whole account) removes that site and its guest data and media. Remaining time on that site is forfeited.

8. Product shutdown and changes to the Service

We may modify, suspend, or discontinue We Wil Marry. Vitalício is not a promise that the product will operate forever, and it does not survive a shutdown.

We do not guarantee uninterrupted, error-free, or fully secure operation. Maintenance, provider outages, and abuse prevention may make the Service unavailable.

9. Gifts

Gift lists are a way for the couple to publish items and amounts. When a guest reports a gift:

  1. We show the couple’s payment instructions (for example PIX or bank details) only after the guest has identified themselves.
  2. The guest transfers money directly to the couple. We Wil Marry is not a payment intermediary, marketplace, escrow, or payment institution. We do not receive the gift funds.
  3. The guest uploads a receipt. We store that file in private storage as unverified evidence for the couple. We do not verify that the transfer happened, that the amount is correct, or that the file is genuine.
  4. The couple may mark a report as confirmed or not found. That is their record-keeping, not a payment confirmation by us.

Disputes about gifts are between the guest and the couple. Do not use the product to collect payments you are not entitled to, or to upload misleading receipts.

10. User content and media

You and your guests may upload text, photos, videos, and (for gifts) receipt files.

You retain whatever rights you already have in that content. You grant Redhead Studios a worldwide, non-exclusive, royalty-free licence to host, store, transcode, display, and back up that content solely to operate We Wil Marry (including Vercel Blob for images and receipts, and Mux for video).

You represent that you have the rights and permissions needed to publish what you upload, including photos of people and places, and that guest-listed names are included lawfully.

Published wedding pages are public at the site link. Anyone with the link can see the couple-authored content. Guest e-mail, phone, receipts, and private messages are not part of that public page.

We may remove content that violates these Terms or the law, or that threatens the Service.

Starter sample copy and art on a new site are ours to replace; they are examples, not your story, and should be edited before you share the link widely.

11. Acceptable use

You agree not to:

  • Use the Service for unlawful purposes, including fraud, money laundering, or harassment.
  • Interfere with the Service, probe it without authorization, or attempt to access another couple’s private data (guest contacts, receipts, billing, unpublished content).
  • Scrape, bulk-export, or publish other people’s personal data from the Service.
  • Impersonate others, or create identities intended to mislead the couple.
  • Upload malware, or content you do not have the right to use.
  • Use editor seats, gift reports, or RSVP tools to abuse guests or the couple.
  • Circumvent time, publish, or access controls.

We may suspend or terminate accounts or sites that violate these Terms.

12. Disclaimer of warranties

The Service is provided “as is”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Wedding dates, maps, RSVP counts, gift reports, and heart totals depend on data you and your guests enter. We are not a party to the wedding, to gift transfers, or to disputes between users.

13. Limitation of liability

To the fullest extent permitted by law, Redhead Studios is not liable for:

  • Gift transfers, failed transfers, or disputes between guests and the couple.
  • Misuse of a public wedding link, or of editor access you granted.
  • Errors in content, RSVP lists, or receipts that users upload.
  • Loss of remaining site time after account deletion, expiry past grace, or a product shutdown.
  • Indirect, incidental, or consequential damages, or loss of data, except where Brazilian law does not allow that limitation.

Where liability cannot be excluded, our total liability related to the Service is limited to the amount you paid us for site time in the twelve months before the claim (or, if you paid nothing, to the legally required minimum).

Nothing in these Terms limits liability for fraud, gross negligence, or other liability that Brazilian law does not allow us to exclude.

14. Indemnification

You agree to defend and indemnify Redhead Studios against claims arising from your content, your guests’ use of your site, your violation of these Terms, or disputes among you, your editors, and your guests — except to the extent caused by our wilful misconduct.

15. Governing law

These Terms are governed by the laws of Brazil. The forum for disputes is the courts of the Capital of the State of Santa Catarina, unless a mandatory consumer rule gives you another forum.

16. Changes to these Terms

We may update these Terms. The effective date at the top of this page is the version we store when you accept. Continued use after a change, or a later acknowledgement at sign-up or onboarding, means you accept the new version. If a change is material, we will update this page; we may also notify account holders by e-mail.
